Employment Contract Review

We are in Rochester, Minnesota, where thousands of physicians train and work at Mayo Clinic. We have wide experience reviewing contracts and counseling physicians seeking their first position, as well as experienced professionals, regarding employment contracts and benefit packages. Our experience in reviewing physician contracts enables us to identify in an employment offer what is common, what is troublesome, how particular contract terms stack up against others, and what is missing. We have experience knowing which terms can sometimes be negotiated, and which are likely non-negotiable.

For new physicians starting off in a private or academic practice, it is important to understand the terms under which you are hired. Some common issues include:

  • What is the actual duration of the contract — what notice is required to resign; what notice is required by the employer to end the employment
  • Noncompete and confidentiality clauses govern practice records and business strategies
  • Malpractice insurance coverage and "tail" (reporting endorsement) coverage
  • Transitioning health benefits from residency/fellowship to the new employment

We will review the contract and benefit summary first, and then meet with you to discuss and provide counsel on the contract. The Klampe Law Firm is able to provide a fast turnaround in these matters as we know time is of the essence for busy professionals. The typical time required for the review and meeting is about one and one-half hours and the typical bill is around $400, subject to complexity of the contract review.
